General Terms & Conditions

In these terms and conditions, the "Company" will mean Eco Exchange Limited and the "Customer" will mean any person, firm, company or body which places an order with the Company through this website (platinumpetfood.com.hk).

Please read these terms and conditions carefully before using the site. By using the site or any part of it, you agree that you have read these terms and conditions and that you accept and agree to be bound by them.


§ 1 Orders
All commentaries, advice and suggestions (collectively, the "Commentary") are subjective opinions of the Company. The Company makes no representations as to the accuracy or the completeness of the Commentary and the Customers shall not rely on the Commentary in making any offer for purchases.
The Customer’s offer to purchase made through platinumpetfood.com.hk are subject to acceptance by the Company. Acceptance by the Company shall be evident by the delivery of the products to the designated address by the Company or its agent. Confirmation of order placement by email shall not be regarded as acceptance of the Customer’s offer to purchase.

The Company reserves the right to:
(1) reject the order in the event that any of the products or services requested are unavailable; and
(2) limit sales and refuse to accept any order (or part of the order), including the right to decline sales to any Customers.

In the event that the Company is unable to fulfill any of the products or services in the Customer’s order we will notify you by phone or email or sms/whatsapp before your requested delivery date.
All information presented on this website is subject to change without prior notice to the Customers.


§ 2 Registration
The Customer shall register before placing any order through this website. During the registration, the Customer shall:
(1) provide us with accurate, complete and up to date registration information;
(2) safeguard your username and password; and
(3) authorise us to assume that any person using the site with your username and password is either you or is authorised to act for you.

The Company has the absolute discretion to refuse registration of a potential customer and to terminate, at any time, the registration of any customer for any reason whatsoever.
The Customer must inform us immediately of any changes to the information that you provided so that we can communicate with you effectively.


§ 3 Breakage
The Customer shall examine the goods immediately upon delivery for any deficiencies and/or damages.

In the event of a claim, the Customer shall:

(1)not accept delivery;
(2)request our agent/driver to return the goods to the Company; and

You need JavaScript enabled to view it. as soon as reasonably practicable but within 2 working days in any event.

If the goods are not returned at the time of delivery, the Company shall have the discretion to refuse the Customer’s claim after delivery.


§ 4 Refund Policy
No return of goods shall be accepted, if any of the following conditions apply:(1)after 7 days of purchase without invoice or receipt; or
(2)any of the original packaging has been damaged; or
(3)in the sole opinion of the Company, the product has been or may have been opened, substituted or in any way tampered.

Refund will be credited into the Customer's bank account provided within 4 weeks upon confirmation.


§ 5 Title & Non-delivery
The Company shall retain title in the products until full payment has been received.
All risks in the products shall pass to the Customer upon delivery.
In the event that:
(1) the goods are non-deliverable within two weeks of purchase due to the Customer's failure to notify the Company of change of address or the Company is otherwise unable to contact the Customer; or
(2) the Customer refuses to take delivery of the goods and does not apply for a refund within 7 days,
then the Company has the right to dispose of the goods with no further notice to the Customer.

The Company shall have no liability to the Customer in respect of disposal of the goods in such circumstances.


§ 6 Payment
The Company accept payment by:
(1) Cash payment upon delivery.
All product prices listed are in HK dollars.

The Company reserves the right to change the payment terms for any order without prior notice.


§ 7 Delivery
The Company offers FREE delivery (single location only) for purchases over HK$300. For orders under HK$300, a delivery charge of HK$100 shall apply.
*If the despatch date is a public holiday, the next delivery date will be the second working day following the relevant despatch date.
Delivery service is limited to Hong Kong, Kowloon and New Territories commercial and residential addresses only. Delivery is not available to outlying islands, restricted areas, hotel guest rooms, ports or marinas.
Delivery service will be suspended when typhoon signal No.8 or above or a black rain warning is hoisted. In this event, the Customers will be contacted to re-schedule delivery time.
Delivery to 4th floor or above will only be made if lift service is available. In the event of a lift breakdown the Company or its agent will make arrangements to deliver the goods at another time.
The Company reserves the right to charge an additional delivery fee if the Customer (or its agent) is not available to accept delivery at the nominated delivery time.
It is the responsibility of the Customer to notify the Company immediately of any change to their delivery address.


§ 8 Others
The Company shall not be liable for any delay or failure in its performance caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond the control of Company.
These terms and conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China ("Hong Kong") and the Customer and the Company agree to submit to the exclusive jurisdiction of the Hong Kong courts.
The Company may revise these terms and conditions at any time without prior notice. If any dispute arises, the Company’s determination shall be final.
Where these terms and conditions are available in Chinese, the English version is the governing version and shall prevail whenever there is a discrepancy between the two versions.


§ 9 Disclaimer
The Company and its associated companies, subsidiaries, employees, agents, contractors and any third party provider (collectively "Eco Exchange") make no representation or warranty in relation to:
(1) the completeness, quality, operation, use, accuracy, or timeliness of, or the fitness or use for any purpose of, platinumpetfood.com.hk or the information stored on or receivable through this or any other platinumpetfood.com.hk server (the "Information");

(2) any goods or services accessed, offered or obtained through platinumpetfood.com.hk or pursuant to the Information;
(3) the access to platinumpetfood.com.hk or the Information will be uninterrupted or error free or that the Information does not contain any viruses, or contaminating or destructive properties.
The Customer shall not rely on the Information. Eco Exchange shall not be liable for any damages, losses, costs or expenses which arise, directly or indirectly, from the Customer’s reliance or use (whether authorized or not) of the Information or this website.
